Resumen:
Este trabajo tiene por objeto reflexionar acerca de la necesidad de impulsar el crecimiento del sector de la biotecnología, reforzándose así el interés hacia su proyección socio-económica, y, con ello, la investigación científica, el desarrollo y la innovación en este campo; lo que, a su vez, propiciará el avance de distintos sectores productivos con alto interés en nuestro país. En particular, se examinan las principales características que identifican a las invenciones biotecnológicas (aquellas que integran o aplican materia viva o biológica). De este modo, reconociendo su especialidad, se procede a ofrecer una exposición detallada de los requisitos legales exigidos para su patentabilidad. Todo ello, conforme al Sistema de patentes vigente, y en orden a observar las principales cuestiones que se suscitan en el ámbito de las invenciones biotecnológicas (a diferencia de lo que acontece con otro tipo de invenciones). En este sentido, el presente texto ilustra sobre la positiva evolución del marco regulatorio aplicable, haciendo especial referencia a la nueva Ley de Patentes 24/2015, de 24 de julio, de patentes que entrará en vigor en abril de 2017.
Abstract:
This paper aims to reflect on the need to boost the growth of biotechnology, reinforcing its socio-economic projection, and with it, scientific research, development and innovation in this field; which, in turn, will promote the advance of different productive sectors, with high interest in our country. In particular, it examines the main characteristics that identify biotechnological inventions, those that integrate or apply living or biological matter. In this way, recognizing its specialty, a detailed description of the legal requirements for its patentability is provided, and according to the current patent system and in order to observe the main issues that arise in the field of biotechnological inventions (unlike other inventions). In this sense, this text illustrates the positive evolution of the applicable regulatory framework, with special reference to the new Patent Law 24/2015, of July 24, of patents that will come into force in April 2017.
